Q. Can Automobile Insurance Companies Be Paid Back From The Negligent Liquor Establishment For The Money The Insurer Paid For The Medical Expense Of The Injured Party? 

A. Subrogation is the right of a auto insurance company to be reimbursed for the expenses they have paid for an injury caused by the negligent acts of a third party. However, subrogation is not allowed against liquor vendors.

1. Minn. Stat. 340A.801,subd. 4 prohibits subrogation actions against liquor vendors by insurance companies for expenditures made in the form of No-fault economic loss benefits, collision coverage payments or uninsured and underinsured motorist benefits.
