Q. Can I Sue The Person Who Caused The Death Of My Loved One And Still Receive No-Fault Benefits? 

A. If your loved one has died as a result of an automobile accident which was the fault of the other driver, you have automatically reached threshold and have an immediate right to sue that driver. In addition, you are also entitled to No-fault benefits as described below.

Q. If I Have Lost A Loved One As A Result Of An Auto Accident, Will There Be Any Insurance To Help Me Pay For The Funeral? 

A. Minnesota No-fault provides up to $2,000 for funeral expense coverage to include such items as casket burial, flowers and an organist. 

Q. Would There Be Any Compensation For Me And My Family If We Lost A Loved One Who Was An Economic Provider? 

A. If an insured has died, threshold has been reached. That gives the bereaved family the right to sue the person who caused the death. In addition to the lawsuit, the No-fault Act provides that the family can receive up to $200 per week for a maximum of $20,000 in survivor's No-Fault benefits if the death occurs within one year of the accident.

Contributions of money or economic value (not including services) the surviving dependents would have received from the decedent are reimbursable. Also included in the category of economic value are the following tangible items: insurance benefits, disability coverage, pension and Keogh plan, proceeds of household business such as crafts or day care, routine household services, and expenses for wages to compensate a replacement worker for running a business.
