Purpose of Mediation:

The basic purpose of our legal system is to provide a way to settle disputes. Over the years this has been a safe and fair system and has contributed greatly to the development of freedom and our democratic way of life. However, as modern life becomes more complicated, the complexity and expense of the legal system increased significantly. People of average means faced with disputes, more common than ever in our increasingly complex world, are finding that the dispute resolution process of our justice system is not fully available because of the rising costs.

Mediation in Civil Cases is Much Less Expensive:

Judges and lawyers are working hard to develop faster, less costly ways to settle disputes within the current legal system. The most common process now in place is mediation. In mediation, the parties involved in a lawsuit choose another person (known as a mediator or third-party neutral) to help them settle their case. The mediator has no real power to make the parties settle, but rather acts as a neutral person who helps the parties focus realistically on the strengths and weaknesses of their own case, as well as the risks and costs associated with going ahead with a full-scale trial.

Although judges cannot make people settle their case, they now frequently require that they at least try to settle with the help of a mediator before they are permitted to go to a trial.

Mediation in Family Law is Much Less Expensive:

In particular, mediation can be very productive in divorce proceedings. Emotions generally run high because the subject is so intimate and personal. The adversarial nature of the litigation process frequently escalates in bitterness, recrimination, acrimony and constant attacks and counter attacks. The mediation process is designed to promote and develop strategies of cooperation which help both parties reach a result that they helped design without the high cost of litigation. The mediation process can be used instead of litigation. As a result, post divorce relationships in such areas as parenting, financial separation and support payments are much easier to solve with the help of a mediator and much less expensive.

Many couples who are divorcing are choosing to try to resolve their separation issues with a mediator first and once the issues are settled with the mediator, they take the final settlement to a lawyer who will write up the divorce decree and file it with the court, thereby saving thousands of dollars in fees and expenses.
