DePuy Orthopedics, a Division of Johnson & Johnson, has recently mandated a recall for two of their hip replacement products, the ASR XL Acetabular System and the ASR Hip Resurfacing System. It has been discovered that these 2 implants are found to place patients at risk for a number of reasons.
The Food and Drug Administration has been receiving complaints from recipients for the past two years concerning these products, complaints that include having pain at the implant site, swelling, and a difficult time walking. If these signs and symptoms continue, it could mean that the implant has become lose, the ball and socket design has become dislocated, or a portion of the bone has cracked.
There is also evidence to suggest that microscopic chromium and cobalt shards can dissolve into the blood stream causing yet unknown problems. It is believed that this alone can take place without any of the other symptoms being present. This is one reason why it is important that recipients of these products speak with their physician about it, even if they are not having any particular issues.
If your hip replacement took place after 2003, you should consult with the physician who performed the implant, and find out whether or not your replacement is part of this DePuy recall. The next thing to do is to get in touch with a good attorney. DePuy Orthopedics has already released patient consent forms that will allow them to gain access to the patient’s medical records, so they can carry out research in order to prevent this condition from happening again, and study any removed ASR product apparatus. Many doctors are requesting that their patients sign these release forms before speaking with an attorney. In order to make sure that you do not prejudice your right to make a claim against the company, it is important for you to consult with a lawyer before signing any documents pertaining to your defective implant.
If you, or someone you know has had a DePuy hip replacement, find out if it is one that has been recalled. They may be entitled to financial compensation. DePuy is prepared to deal with “reasonable and customary” medical costs, but without the help of an experienced attorney, patients may not receive all that they are entitled to. The pain and suffering associated with implant surgery, and the potential long term medical problems are conditions that should be considered.
